Terms of Service

1. Welcome
These Terms of Service (the “Terms”) govern your use of the Clipster apps and services (together, the “Service”). By creating an account or using the Service, you accept these Terms. If you do not agree, please do not use the Service.
2. Who we are

References to “we”, “us” or “our” in these Terms mean Hugo S. operating under that status. The Service is hosted on infrastructure provided by Cloudflare, Inc.
3. The service
Clipster is a clipboard manager available on macOS, Windows and iOS. It lets you keep, search and reuse what you copy, and — at your option — synchronise it across your devices through an end-to-end encrypted sync layer.
We are continuously improving the Service. We may add, change, or remove features over time.
4. Eligibility and your account
You must be at least 16 years old to use Clipster. By creating an account you confirm that you are at least 16.
You are responsible for maintaining the confidentiality of your sign-in credentials and your encryption password, and for all activity that happens under your account. If you suspect any unauthorised access, contact us immediately.
We may suspend or terminate accounts that we reasonably believe are being used in breach of these Terms or applicable law.
5. Free and paid plans
Clipster offers a free plan with a generous set of features. We may also offer paid plans (“subscriptions”) with additional features, storage, or sync capacity.
When paid plans are available:
- Subscription pricing, billing frequency and feature scope are displayed before you subscribe.
- Web subscriptions are billed by Stripe on our behalf. Subscriptions made through the iOS App Store are billed by Apple under your Apple ID.
- Subscriptions renew automatically at the end of each billing period unless cancelled. You can cancel at any time from the app — or, for App Store subscriptions, from your Apple ID settings. Cancellation takes effect at the end of the current period.
- We may change subscription prices with reasonable advance notice. Changes apply to subsequent billing periods only, never retroactively.
6. Right of withdrawal (EU consumers)
If you are a consumer in the European Union, you normally have a 14-day right of withdrawal when subscribing to a paid plan online, under Article L221-18 of the French Code de la consommation.
Because Clipster is digital content delivered immediately and a digital service that you start using as soon as you subscribe, by ticking the relevant box at checkout you expressly request immediate provision of the service and acknowledge that you lose your right of withdrawal once the service has been fully provided, in accordance with Article L221-28 of the Code de la consommation.
If you have not yet ticked that box and not used the paid features, you can exercise your right of withdrawal within 14 days by emailing contact@clipster-app.com, and we will refund the corresponding amount.
7. Acceptable use
You agree not to:
- use the Service to store or transmit content that is unlawful, infringing, defamatory, obscene, or otherwise objectionable;
- attempt to break, reverse-engineer, or otherwise compromise the security or integrity of the Service, except to the extent expressly permitted by mandatory law;
- use the Service in a way that interferes with other users, overloads our infrastructure, or circumvents usage limits or paid features;
- use the Service to send unsolicited communications or to engage in any form of automated abuse;
- resell, sublicense or commercially redistribute the Service without our prior written agreement.
You remain solely responsible for any content you store in the Service, including its lawfulness and your right to store it.
8. End-to-end encryption — your responsibility
Clipster is designed as a zero-knowledge service: your clipboard content is encrypted on your device with a key derived from a password that only you know. We never receive that password.
Important. We cannot recover your encrypted data if you lose your encryption password. You are responsible for keeping that password safe. We strongly recommend writing it down or storing it in a password manager. We will not be liable for data that becomes unrecoverable due to a lost or forgotten encryption password.
9. Intellectual property
The Clipster apps, websites, brand, name, logos, designs and source code (other than the third-party components listed in our open-source notices) are owned by Hugo S. and protected by intellectual property laws.
We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the apps and the Service in line with these Terms.
You retain all rights in the content you store using the Service. You grant us only the limited technical permissions strictly necessary to operate the Service on your behalf — for example, storing your encrypted blobs and serving them back to your devices.
10. Third-party software
The apps include third-party open-source components, listed under “Acknowledgements” or equivalent inside the app. Those components are licensed under their own terms.
11. Service availability
We do our best to keep the Service available and functioning as expected, but we do not guarantee that it will be uninterrupted, error-free, or available at all times. We may schedule maintenance, perform updates, or temporarily suspend parts of the Service when reasonably necessary.
12. Disclaimers and statutory rights
The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all implied warranties — except those that, under the law applicable to you as a consumer, cannot be excluded. In particular, French and EU consumer law gives you mandatory rights regarding conformity of digital services and digital content, which apply on top of these Terms and are not limited by them.
13. Limitation of liability
To the extent permitted by applicable law, we are not liable for indirect or consequential damages, including loss of data, loss of profits, business interruption, or loss of goodwill. Our total aggregate liability arising out of or in connection with the Service is limited to the amount you have paid us during the twelve months preceding the event giving rise to the claim, or fifty (50) euros if you are a free user.
Nothing in these Terms limits any liability that cannot be excluded by law — including, for consumers in the EU, liability for gross negligence, wilful misconduct, or harm to life and health.
14. Termination
You can stop using the Service and delete your account at any time from inside the apps.
We may suspend or terminate your account if you breach these Terms or use the Service in a way that creates legal or security risks. Where reasonable, we will give you advance notice and a chance to fix the issue.
When your account is deleted, your encrypted data is removed from our servers as described in our Privacy Policy.
15. Changes to these terms
We may update these Terms from time to time. When we make a material change, we will update the “Last updated” date at the top and, when appropriate, notify you in the app or by email. Your continued use of the Service after a change means you accept the updated Terms.
16. Governing law and jurisdiction
These Terms are governed by French law, without regard to conflict-of-laws rules.
If you are a consumer, mandatory consumer-protection rules of the country where you live still apply.
For any dispute that cannot be resolved amicably, the competent courts are those designated by the French Code de procédure civile. If you are a consumer, you may choose to bring the dispute either before the courts of your place of residence or before the courts of our place of residence.
You also have the right to use the European Commission's Online Dispute Resolution platform: ec.europa.eu/consumers/odr.
17. Miscellaneous
If any provision of these Terms is found to be unenforceable, the remaining provisions stay in force. Our failure to enforce a right is not a waiver of that right. These Terms are the entire agreement between you and us regarding the Service.
